VANCOUVER, BC—(Marketwired – December 29, 2017) – Vancouver family lawyers discuss why pre–dispute agreements may be the most effective way to avoid family law litigation
As a team of family lawyers, the professionals at Kushner Law Group understand that family law disputes are often economically, emotionally, and physically taxing on all parties. The latest blog on the company website explores why the most effective way to avoid family law litigation may be to come to an agreement with a spouse or soon–to–be spouse prior to a relationship breakdown. Family Law Agreements are designed to protect the rights and assets of both parties while avoiding costly litigation. The Family Law Act provides parties with the ability to file agreements with the Court and to have those agreements enforced.
Three critical aspects to an enforceable and strong Family Law agreement are:
1) Full and accurate financial disclosure from both parties,
2) Independent legal counsel for each partner, and
3) Fair and reasonable terms for both parties.
It's important to understand that if either party fails to make disclosure or hides assets, the agreement may be challenged. Likewise, if the Court determines that the terms of an agreement are unfair, the will may be subject to variation in the future.
To have an agreement drafted or for advice in a family law dispute, contact the Kushner Law Group and schedule a consultation.
